By accessing or using the blackhawnketnork platform, API, or any related services, you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately. Continued use after any modification constitutes acceptance of the updated terms.
blackhawnketnork provides a gift card issuance and management API infrastructure for developers and businesses. The service includes API access, key management, sandbox environments, and associated developer tooling. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
You must provide accurate information when registering an account. You are solely responsible for maintaining the confidentiality of your API keys and account credentials. Any activity conducted under your account is your responsibility; notify us immediately at [email protected] if you suspect unauthorized access.
Subscription fees and usage-based charges are billed in advance or in arrears as specified in the applicable pricing plan. All fees are non-refundable unless expressly stated otherwise. We may suspend API access if payment obligations are not met within 7 days of the due date.
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle. Gift card credits issued through the API are governed by the end-issuer's policy and are not refundable by blackhawnketnork.
All intellectual property in the blackhawnketnork platform, including source code, API design, documentation, trademarks, and trade dress, is owned by blackhawnketnork or its licensors. You are granted a limited, non-exclusive, non-transferable license to integrate our API into your products solely as permitted by these Terms.
You may not use the service for unlawful purposes, to issue fraudulent gift cards, to circumvent financial regulations, to scrape or reverse-engineer our systems, or to resell API access without prior written authorization. Violation may result in immediate termination and legal action.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability. blackhawnketnork does not warrant that the API will be error-free or that defects will be corrected within any specific timeframe.
To the maximum extent permitted by applicable law, blackhawnketnork's aggregate liability for any claims arising out of or related to the service shall not exceed the fees you paid in the three months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages.
Either party may terminate these Terms with 30 days' written notice. We may terminate immediately upon material breach, non-payment, or suspected fraudulent activity. Upon termination, your API keys are revoked and you must cease all use of the service.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
